Terms and Conditions of Use

Welcome to Safe Listening Therapy.  By accessing or using our website, services, and platforms (collectively referred to as the "Site" or "Service"), you agree to be bound by these Terms and Conditions ("Terms").

1. Acceptance of Terms

By accessing or using the Site, you agree to comply with and be bound by these Terms, including any amendments or modifications made from time to time. We may update these Terms at our discretion, and the updated version will be effective as soon as it is posted on the Site.

2. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Site. If you are under the age of 18, you may use the Site only with the permission and supervision of a parent or legal guardian.

3. Use of the Service

Safe Listening Therapy offers online therapy services provided by a Licensed Therapist. These services include a combination of audio and video content designed to promote mental wellness and healing. The Service is for personal, non-commercial use only. You agree to use the Site and the Service only for lawful purposes and in accordance with these Terms.

You are prohibited from using the Site:

  • In any way that violates applicable local, state, national, or international law or regulation.

  • To transmit any harmful or illegal content, including viruses or malware.

  • To engage in any activity that would disrupt or impair the functionality of the Site or Service.

4. Licensed Therapist Services

All therapy services offered on the Site are provided by a Licensed Therapist, qualified and trained to deliver mental health services. By using the Site, you acknowledge that:

  • Therapy services are provided by a therapist licensed in the state or jurisdiction where they are practicing.

  • While we strive to offer the best possible service, therapy sessions are not a substitute for emergency medical or psychiatric care.

  • You are encouraged to consult a healthcare provider for any medical or psychiatric emergencies.

5. Account Registration and Security

To access certain features of the Site, you may be required to create an account. When creating an account, you agree to provide accurate, current, and complete information and to update such information as necessary. You are solely responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

6. Medical Disclaimer

Safe Listening Therapy does not provide medical or psychiatric treatment. The content and services offered through the Site are not intended as a substitute for professional diagnosis, treatment, or therapy. You should consult with a qualified healthcare provider if you have any concerns about your mental health or well-being.

7. HIPAA Compliance

Safe Listening Therapy is committed to safeguarding the privacy and security of your personal health information. We comply with all applicable provisions of the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Health Information Technology for Economic and Clinical Health Act (HITECH Act) as well as their associated regulations.

a. Protected Health Information (PHI): In the course of providing services, we may collect and maintain personal health information, including but not limited to health history, assessment notes, therapy progress, and session records. We are committed to keeping this information confidential and secure.

b. Uses and Disclosures of PHI: We will only use or disclose your PHI as permitted or required by law, or with your express written consent. This includes disclosures for treatment purposes, healthcare operations, or as otherwise required to comply with legal or regulatory requirements.

c. Security of Your Data: We implement physical, technical, and administrative safeguards to protect the privacy and security of your PHI. All data shared during therapy sessions is encrypted to ensure confidentiality.

d. Your Rights: Under HIPAA, you have the following rights regarding your health information:

  • Right to Access: You have the right to access and obtain a copy of your PHI maintained by Safe Listening Therapy.

  • Right to Amend: You have the right to request amendments to your PHI if you believe it is inaccurate or incomplete.

  • Right to Request Restrictions: You may request restrictions on the use or disclosure of your PHI, though we are not obligated to agree to all requested restrictions.

  • Right to Confidential Communications: You can request that we communicate with you in a specific way (e.g., through a different email address).

  • Right to File a Complaint: If you believe your privacy rights have been violated, you have the right to file a complaint with Safe Listening Therapy or with the U.S. Department of Health and Human Services.

8. Privacy and Data Protection

Your use of the Site is also governed by our [Privacy Policy], which outlines how we collect, use, and protect your personal information. By using the Site, you consent to the collection and use of your personal data as described in our Privacy Policy.

If you are a client receiving therapy through our services, we may collect and process personal information, including PHI, as described above. All PHI will be handled in compliance with applicable privacy laws, including HIPAA.

9. Fees and Payment

Services on the Site requires payment.  There is a 24 hours cancellation policy  in place, after which there is an $85.00 Rescheduling or Cancellation Fee. By booking services with Safe Listening Therapy, you agree to pay any fees associated with your use of the Site and services offered. Payment details and processing may be handled through our third-party payment processors. All payments are non-refundable unless otherwise stated.  

10. Intellectual Property

The content on the Site, including text, graphics, images, videos, logos, and software, is the property of Safe Listening Therapy or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content from the Site without our express written permission.

11. User-Generated Content

If you submit or contribute any content to the Site (such as reviews, feedback, or comments), you grant us a non-exclusive, royalty-free, worldwide license to use, modify, display, and distribute the content for any purpose related to the operation and promotion of the Site.

You agree not to submit any content that is:

  • Infringing on the intellectual property rights of others.

  • Defamatory, offensive, or otherwise unlawful.

  • Personal or confidential information about yourself or others without consent.

We reserve the right to remove any content that violates these Terms or that we deem inappropriate at our sole discretion.

12. Limitation of Liability

To the maximum extent permitted by law, Safe Listening Therapy and its affiliates, directors, employees, agents, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or the services provided, even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless Safe Listening Therapy and its affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Site.

  • Your violation of these Terms or any applicable laws.

  • Any content you submit to the Site.

14. Termination

We reserve the right to suspend or terminate your access to the Site, without notice, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Site will immediately cease, and you must destroy any copies of the content you have obtained from the Site.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Safe Listening Therapy is based, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved exclusively in the competent courts of that jurisdiction.

16. Dispute Resolution

If you have any disputes with us, we encourage you to contact us first to attempt to resolve the issue. In the event that a resolution cannot be reached, any legal disputes will be subject to binding arbitration in accordance with the rules of [Arbitration Institution] in the jurisdiction mentioned above.

17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make changes, we will post the updated Terms on the Site, and the revised Terms will take effect immediately. Your continued use of the Site after such changes constitutes your acceptance of the updated Terms.

By using the Safe Listening Therapy Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
